General Terms and Conditions

1. General

Unless expressly agreed otherwise, our General Terms and Conditions (AGB) apply to all transactions between Skischule Poppenberg GbR and customers.

The company's business involves operating snow sports schools (ski schools).

This includes services such as providing instruction in the skills and knowledge of snow sports, especially skiing and snowboarding (without guaranteeing a specific level of training success), as well as guiding and accompanying snow sports, especially skiing and snowboarding.

2. Conclusion of Contracts for Offers, Online Price Inquiries, and Prices

Reservations for private and group courses can be made via the internet, email, or by phone.

Reservations are considered confirmed only after on-site payment and are firmly booked by Skischule Poppenberg GbR.

The offers of Skischule Poppenberg GbR are non-binding.

For the acceptance of the reservation and the scope of the service, only our written order confirmations are binding.

Oral or telephone side agreements are only valid with the explicit written confirmation of Skischule Poppenberg GbR.

For on-site bookings (private and group courses), a contractual relationship is only established upon the purchase of the necessary course cards.

All prices mentioned by us are in euros and, unless otherwise agreed, include the statutory value-added tax.

Price lists are provided without guarantee, and we are not liable for errors.

3. General Participation Conditions

The contracting party must truthfully and comprehensively inform Skischule Poppenberg GbR about their skiing abilities and experiences and independently ensure suitable equipment that corresponds to the state of skiing technology and external conditions.

They must also provide comprehensive information about their health condition and any existing medical conditions to Skischule Poppenberg GbR.

Before the start of the lessons, the contracting party must independently arrange for the inspection of the skiing equipment (especially ski bindings) by a specialist company.

The grouping of ski courses is done by Skischule Poppenberg GbR.

If a downgrade of a participant is necessary, the contracting party must follow this decision; otherwise, Skischule Poppenberg GbR is entitled to terminate the contract.

Instructions from Skischule Poppenberg GbR must be followed by the contracting party.

Failure to comply with instructions and warnings entitles Skischule Poppenberg GbR to immediately terminate the contract.

The influence of alcohol and drugs entitles Skischule Poppenberg GbR to immediate termination of the contract.

In the described cases, the contracting party is not entitled to a refund of the fees paid.

In the case of group courses, if the number of participants decreases to less than 5 people, Skischule Poppenberg GbR reserves the right to merge these groups or reduce the teaching hours.

4. Liability Provisions

Every participant is strongly recommended to take out health, accident, liability, and foreign health insurance!

Skischule Poppenberg GbR is liable in accordance with legal provisions exclusively for damages directly related to the activities of Skischule Poppenberg GbR and caused intentionally or by gross negligence.

Corresponding liability insurance policies are in place.

5. Warranty

Any complaints must be reported immediately on-site to the Skischule Poppenberg GbR office to rectify the situation.

There is no entitlement to a reduction in the fee for culpable non-reporting. Claims against Skischule Poppenberg GbR must be made in writing and justified no later than 4 weeks after the damage occurred.

6. Cancellation

For group courses, a refund of payments already made is only possible in the case of accidents and illness, with the presentation of the original receipt (course card) and a medical certificate from a local doctor.

The refund amount will be recalculated based on the services actually provided for this period.

The total amount may be reduced, but daily rates may increase.

No refund will be provided for non-attendance at the agreed-upon date or for the cancellation of ongoing services.

In the event of course cancellations due to weather conditions (force majeure), the fee paid will not be refunded.

7. Lift Costs

Participants are responsible for their own lift tickets. The conveyor belt (30m small) in the ski kindergarten is included in the price (during course hours).

Information about lift ticket prices in advance is non-binding.

8. Lunch Break

During the lunch break, parents or another authorized person must supervise the children.

The children must be picked up personally at the location agreed upon with the ski instructor.

9. Participants/Age

Participants from the age of 5 (ski course) and 10 years (snowboard course) can be registered in the ski school. A good physical condition is required for all age groups (in case of complaints or physical disabilities, consult your family doctor).

10. Exclusion from the Course

In case of complaints from other course participants, parents, or ski instructors about the inappropriate behavior of a course participant during the course, Skischule Poppenberg GbR may exclude the respective course participant from further participation in the course.

In this case, there is no right to a refund of partial fees.

11. Lost or Damaged Items

Skischule Poppenberg GbR is not liable for skis, boots, accessories, clothing, money, and personal items that are lost or damaged during lessons or breaks.

12. Place of Performance

Skischule Poppenberg GbR is located in the municipality of Winterberg, North Rhine-Westphalia, Germany.

13. Jurisdiction

The competent court at the seat of Skischule Poppenberg GbR is exclusively responsible for deciding all disputes arising from this contract.

14. Choice of Law

German law applies.

15. Legal Effectiveness

If individual provisions of these terms and conditions are or become invalid, this shall not affect the validity of the remaining provisions and the entire legal transaction. The invalid provision is to be replaced by one that economically comes closest to the invalid provision.

16. Payment

Credit card payments to the benefit of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain in which you enter and process your payment is owned by TREKKSOFT and operated by TREKKSOFT.
